A class-action lawsuit, filed in United States District Court in the Northern District of Illinois Eastern Division, claims that Dunkin’ Donut’s blueberry bakery items contain imitation blueberries that highly resemble the real thing. The coffee chain’s Blueberry Butternut Cake, Blueberry Cake Donut, and Blueberry Crumb Cake contain flavored crystals made of sugar, corn syrup and blue dye; however, its blueberry muffins do contain the real thing.
According to the lawsuit, "Due to their blue color and round shape, the 'flavor crystals' and 'blueberry flavored bits' are inserted strategically on the inside and outside of the Blueberry Products to induce unsuspecting consumers into believing that the products contain actual blueberries." It also goes on to talk about deceptive marketing, in which their products are advertised next to real blueberries and labeled as such. The suit is seeking $5 million in damages, restitution, and court fees.
This claim comes months after Chefun Chen, a resident of Queens, filed a federal class-action lawsuit against Dunkin’ Donuts, alleging that the company’s Angus Steak and Egg Sandwich doesn’t contain any actual steak. Chen’s lawsuit accuses the coffee store of “false, deceptive and misleading” advertisements for claiming their steak-and-egg sandwiches contain steak, when they’re actually made of ground beef. Chen is seeking unspecified monetary, compensatory, and punitive damages, as well as restitution and attorney fees. You can read more about Chen’s lawsuit here.
